This Ecruising Travel Promotion is offered subject to the terms and conditions set out below "Terms and Conditions".

Who can Enter

• Entry is only available to residents of Australia who are aged 18 years or older.
• Employees, officers and contractors (and their Immediate Families) of the Promoter or of the agencies or companies associated with this Promotion are ineligible..

How to Enter

1. Entrants must complete the online entry form found on the Ecruising Travel.com Competition page and fill in all required fields.
2. Entrants must subscribe to receive newsletters and be a subscriber at the time of the prize draw
3. Entrants must agree to the competition Terms & Conditions to be eligible for a chance to win the prize.
4. Entrants must be a new subscriber and not already existing in the database before the competition start date
5. Entries must include all requested contact details and form questions, including a valid email (as requested), to be eligible to win. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries will be deemed invalid
6. Eligibility information and the prize offered form part of these Conditions of Entry. An individual that renders themself an Eligible Entrant is deemed to have accepted these Conditions of Entry.
7. The promotion starts 10.00am AEST October 1 2024.
8. The promotion ends 11.59pm AEST December 14 2024.
9. The winner will be drawn 9.00am AEST 18 December 2024.

The Prize on Offer

• The prize consists of one (1) ecruising.travel Travel Voucher to the value of AUD$1000.00
• The Prize Winner (by accepting a Prize) agrees that they will abide by the applicable terms and conditions for the use of the prize as notified by the Promoter and/or the prize issuer.
• Eligible Entrants may only receive one (1) prize across the Promotion Period.
• The Prize Winner must take the prize as offered. The prize is non-transferable, non-refundable, cannot be sold or exchanged for cash (except as permitted through normal use of the prize) and cannot be used in conjunction with any other offer.
• The prize and use of the prize are subject to the standard terms and conditions of the Promoter. These terms and conditions can be found at https://www.ecruising.travel/terms-and-conditions
• Prize may be redeemed on one booking in whole or part during the validity period. Where used in part, remaining funds will be forfeited and cannot be used for future purchases.
• In the event a winner does not take the prize within the timeframe stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

Terms and Conditions

1. There is one AUD$1000.00 Travel Voucher to be won over the period of the competition. 
2. The entrant must be a new subscriber and not already existing in the database before the competition start date
3. The Travel Voucher is offered by Ecruising Travel Pty Ltd
4. The Travel Voucher is available for use only by Australian residents over the age of 18.
5. The Travel Voucher cannot be redeemed or exchanged for any other form of services or cash.
6. The Travel Voucher can only be used for Cruise ONLY bookings and excludes: travel insurance, flights, pre and post accommodation, shore excursions, onboard incidentials, transfers.
7. Where the cruise is above AUD$1000.00 the winner will pay the additional amount to make up the total coast of the booking.
8. The Promoter will ensure that all entries have an equal chance of winning the prize.
9. The winner/s will be notified via email (as determined by the address provided by the entrant) within two business days of the draw. The winner will also be published via Facebook.
10. No responsibility can be accepted for entries not received for whatever reason.
11. Winner will be chosen at random by software, from all entries received and verified by the Promoter and or its agents.
12. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
13. By submitting an entry into this competition, entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
14. This is a single-use Travel Voucher. Any unused portion of the Voucher is forfeited and is not redeemable for cash or other forms of credit.
15. Notification and claiming the Prize. Following the Prize draw, the winner will be notified in writing within seven days using the contact details provided by the Entrant. The winning Entrant has 14 days from the time and date of the notification being sent to respond, provide proof of eligibility and claim the Prize. 
16. In the event the Prize is not claimed by the winning Entrant within the specified time frame, the Winner will forgo all claims to the Prize.
17. If the winner cannot be contacted or does not claim the Prize within 14 days of notification, we reserve the right to withdraw the Prize from the winner and pick a replacement winner. 
18. Any unclaimed prizes will be drawn and published as per Item 1 of the Schedule.
19. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
20. The Redemption Date for the Travel Voucher is 30 June 2025. The Travel Voucher must be booked no later than this date or the Travel Voucher prize is forfeited in full.
21.  All bookings are subject to availability at the time of booking, cannot be combined with any live specials and tactical campaigns in the marketplace and are subject to all applicable booking terms and conditions of the Accommodation Supplier and Ecruising Travel.
22. This Travel Voucher will be deemed fully used once a qualifying booking has been made and confirmed to be available. The Travel Voucher will not be reinstated, refunded or replaced, even in the event that the reservation is cancelled or changed for any reason, including operational or weather-related issues.
23. Changes or a Cancellation requested by the winner may incur charges from Airlines, Hotels or other Suppliers. The winner is responsible to pay any such charges and The Travel Voucher cannot be applied to any additional costs associated with changes or cancellations to the original booking requested by the winner.
24. There is no residual value and no credit will be issued if the booking amount is less than the Travel Voucher amount.
25. The winner may add services or stay additional nights, however the winner is responsible for any additional costs.
26. To redeem the Travel Voucher, email your Ecruising Travel Consultant and advise them in the email you have a Travel Voucher to redeem.
27. The Travel Voucher is not transferable, exchangeable, replaceable or refundable for cash or credit and can only be used as specified.
28. All taxes, fees, charges and surcharges applicable to the booking, including, without limitation, extra person, phone, parking and other charges are applicable to your reservation, and this Travel Voucher cannot be applied to them. These charges must be paid at the time the reservation is confirmed or to the hotel property directly and are the responsibility solely of the winner.
29. The Travel Voucher cannot be applied to any costs or miscellaneous fees charged by the Hotel or Airline and incurred by the winner.
30. Terms and conditions of this offer are as written and cannot be changed by any representation of any unauthorised person, including employees of Ecruising Travel.
31. Travel Voucher is void where prohibited or restricted by law.

33. Proof of age and residency may be required to claim the prize and is at the discretion of Ecruising Travel.
34. Ecruising Travel reserves the right to change these terms and conditions without notice and at any stage during the promotion.
35. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

An individual who complies with these eligibility requirements will receive one entry only in the Promotion.

General Terms and Conditions

1. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees". 

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Ecruising Travel Pty Ltd (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

1. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Ecruising Travel Pty Ltd (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
   1. any technical difficulties or equipment malfunction (whether or not under Ecruising Travel Pty Ltd's control);
   2. any theft, unauthorised access or third party interference;
   3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Ecruising Travel Pty Ltd) due to any reason beyond the reasonable control of Ecruising Travel Pty Ltd;
   4. any variation in prize value to that stated in these Terms and Conditions;
   5. any tax liability incurred by a winner or entrant;
   6. or use of a prize.
2. Ecruising Travel Pty Ltd collects claimants'/entrants' personal information in order to conduct the promotion. If the information requested is not provided, the claimant/entrant may not be able to participate in the promotion. Ecruising Travel Pty Ltd will not disclose this information to anyone other than contractors who provide services to Ecruising Travel Pty Ltd for the purposes of conducting this promotion unless compelled or permitted by law. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to the Privacy Officer of Ecruising Travel Pty Ltd.
3. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
4. The Promoter reserves the right to cancel or amend the competition and these Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter's control. Any changes to the competition will be notified to entrants as soon as possible by the Promoter.
5. Due diligence is carried out to ensure the providers used in our competitions have health and safety measures in place at the time of promotion. We recommend contacting the product provider(s) to confirm any details and to ensure their latest initiatives comply with all Health & Safety and regulatory requirements ahead of taking up your prize.
6. The Promoter shall not be liable for any loss or damage suffered or inflicted by you (including but not limited to direct or consequential loss) in connection with this competition.
7. The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current New Zealand data protection legislation and will not be disclosed to a third party without the entrant's prior consent.
